
DIMAPUR, OCTOBER 13: The Kohima Bench of Gauhati High Court on Thursday issued notice to Nagaland State respondents in a case alleging non-payment of contract amount despite completion of the project 4 years ago.
According to Court records, the writ petition was filed by a Government-registered Contractor, P Suohu
“The case of the petitioner in brief is that by the order dated April 20, 2015 issued by the Chief Engineer, Police Engineering Project, the petitioner was awarded the contract work for construction of Type-I quarter at PS Tuensang under TFC 2014-2015 (construction of Barrack Type-I 48×22-I units) amounting to Rs 28,56,650
“It is the case of the petitioner that the work allotted to the petitioner has been completed as per the terms and condition laid down in the aforementioned work order and to this effect the Superintendent of Police has issued the work completion certification”, it stated.
The petitioner’s Counsel, Nuksungtila, submitted that the building was handed over to the Superintendent of Police as shown by the letter dated June 25, 2018.
“It is further submitted by the learned Counsel that numerous representations has been filed by the petitioner, one of such being the letter dated March 4, 2022 which is addressed to the Chief Engineer (PEP), Government of Nagaland, Kohima, seeking release of the bill amounting to Rs 28,56,650.
“However, no action has been taken by the respondent authorities to release the bill which is due to the petitioner. Being aggrieved, the present writ petition has been filed”, it added.
Accordingly, Justice Kakheto Sema directed the Registry to issue notice to the respondents, returnable within 4 weeks.
