Rapist stepfather gets 20 years imprisonment

KOHIMA, MAY 4: A Special Court in Kohima has sentenced a man to 20 years imprisonment for raping his 5-year-old stepdaughter in 2019.
The judgement was delivered by Special Judge Y Longkumer of the Kohima Special Court on Protection of Children from Sexual Offences (POCSO) Act on May 2, informed Public Prosecutor Kohima T Marlemba here today.
He said that the Special Judge convicted accused Joseph Adivasi for raping his 5-year-old stepdaughter on several occasions in 2019, at their home in Kohima.
The accused was convicted under Section 376 (2) (3) IPC, to be read with Section 4 of POCSO Act and sentenced to undergo 20 years imprisonment along with a fine of Rs 5000 in default to undergo simple imprisonment of one month.
This case was registered at Women Police Station, Kohima, and was investigated by UBSI Tsuponi Tsukru, the Public Prosecutor said.
While pronouncing the judgement on May 2 in the open court, Marlemba said that the Special Judge had stated that the prosecution has successfully proven the charge beyond reasonable doubt against the accused person.
The Court further observed that considering the nature and gravity of the offence, the provision of the Probation of Offenders Act 1958 would not be made applicable to the convict.
The accused was convicted and sentenced under Indian Penal Code as per the provisions of Section 42 POCSO Act (Alternate punishment) under the provision of which the court can impose punishment greater in degree, he said.
