DIMAPUR, SEPTEMBER 28: The State Commissioner for Persons with Disabilities has issued a suo motu notice to the Principal Director, Directorate of Treasuries & Accounts, for failure to comply with the 4% reservation for Persons with Benchmark Disabilities
The Government of Nagaland, in a notification dated 13.08.19 issued by the Personnel and Administrative Reforms Branch, had reserved 4% of vacancies in favour of Persons with Benchmark Disabilities as envisaged under Section 34 of the Rights of Persons with Disabilities Act, 2016.
However, the reservation was not complied with in the recruitment process to fill up 5 posts of LDA-cum-Computer Assistant, 4 posts of Accounts Assistant and 35 posts of Junior Accounts Assistant under the establishment of the Directorate of Treasuries & Accounts, Nagaland.
In a press release, State Commissioner for Persons with Disabilities, Diethono Nakhro said despite several communications and reminders on the matter by the Office of the State Commissioner, the recruitment process was carried forward in blatant disregard of the Government notification for 4% reservation for which the notice was issued giving them an opportunity to make a course correction within 3 months.
“It is very disheartening to see the nature of how the 4% Reservation for Persons with Benchmark Disabilities which was Notified by the Government is being dealt with and that too by a Government Servant, which is very unbecoming. The whole basis for which the Persons with Disabilities Act of 2016 came into being is to avoid such anomalies and to ensure Inclusion and give Equal Opportunity to all. The Act must not only be accounted for in letter but implemented in toto,” stated the suo motu notice:
“Now therefore, this Notice is issued giving you an opportunity to make a course correction and to rectify the blatant disregard of the Government Notification for 4% reservation for Persons with Benchmark Disabilities by publishing a Corrigendum whereby the Advertisement bearing NO.DTA/ESTT-119/19 dated 14.10.19 must include reservation for Persons with Benchmark Disabilities along with the number of posts reserved in each group of posts and, further, to reschedule the written examination for only those candidates with benchmark disabilities so that it is not contrary to the Notification bearing NO.DTA/CON-119/2019-20 dated 8.05.2020 declaring the list of candidates selected in the Written Examination held on 14.12.19. This would be just and fair in giving equal opportunity to Persons with Benchmark Disabilities to apply for the posts. This has to be complied with within 3 months of receipt of this Notice.”
The notice cautioned that failure to comply with the terms of the notice, a suo motu case shall be initiated against the Department for non-compliance of the notification bearing NO.AR-3/GEN-9/97(Pt) dated 13.08.19 and the Rights of Persons with Disabilities Act, 2016 by initiating civil as well as criminal proceedings against Principal Director, Directorate of Treasuries & Accounts under the relevant provisions of law.
