No promotion to 11 VSAs: HC directs DoV&AH

DIMAPUR, SEPTEMBER 13: The Kohima Bench of Gauhati High Court on Tuesday issued an interim order directing the State’s Department of Animal Husbandry & Veterinary Services not to promote or accord benefit to 11 Veterinary Assistant Surgeons (VSAs) till the next hearing.
The ruling was delivered in a writ petition filed by 41 VSAs and 1 Farm Manager, all employed in the Department.
“Contending that the private respondent Nos. 5 to 14 (10 VSAs) whose regularisations in service were quashed and set aside by this Court in WP(C)/225(K)/2011, have been wrongly and illegally included in the final seniority list of officers in the Department of Animal Husbandry & Veterinary Services, notified on July 1, 2020, the petitioners are here before this Court challenging the same.
“Further, contending that respondent No. 15 (1 VSA) was also regularised in the same manner as the above stated respondents and therefore, his regularisation order is illegal, they have also challenged the regularisation order dated August 20, 2014 issued by the Secretary to the Government of Nagaland, Department of Animal Husbandry & Veterinary Services”, stated a Court document.
In his ruling, Justice Songkhupchung Serto directed the Registry to issue notice to the respondents, returnable within five weeks.
“List the matter again immediately after five weeks. The interim prayer shall be heard on the returnable date. However, no promotion or any benefit should be given to the private respondent Nos. 5 to 15 by virtue of the impugned seniority list till the next date of hearing”, the order stated.
