DIMAPUR, NOVEMBER 24: The Principal District & Sessions Judge, Dimapur, has rejected the prayer for stay on the Interlocutory Application (IA) 76/2020 filed by petitioners in the case connected to the appointment of office bearers of Naga Council Dimapur, and the same was disposed off.
According to an Order issued by the Principal District & Sessions Judge, Y Longkumer, the Learned Civil Judge (Senior Division), on October 19, 2020, passed an order in connection with IA 93/2020 arising out of Civil Suit 6/2020, disposing off the same and restraining the newly appointed Naga Council Dimapur office bearers (inducted on August 22, 2020) from functioning as office bearers of NCD and observed that any of the parties can approach the court for appointment of care-takers in case of exigencies.
Subsequently, IA 76/2020 arising out of Civil Appeal 3/2020 was filed praying for stay of the impugned order mentioned above. The same was dismissed with the view that doing so would result in multiplicity of litigation connected to the same matter, and was disposed off, since the original Civil Appeal from which it arose is sub judice and serious questions of law/merits of the original matter cannot be gotten into in an interlocutory application proceeding.
