DIMAPUR, JUNE 15: The Kohima Bench of Gauhati High Court has ordered the personal appearance of Principal Secretary of Health and Family Welfare if personnel of Mental Health Review Board (MHRB) are not appointed by the next hearing, i.e., July 10.
In an order issued on June 14, a Bench comprising Chief Justice Vijay Bishnoi and Justice Lanusungkum Jamir noted that on May 8, the Court had granted time to the Senior Government Advocate to submit necessary instructions regarding appointments of personnel for the Mental Health Review Board.
“Mr. Moa Imchen, learned Senior Government Advocate, Nagaland, has submitted that the matter regarding appointments of the personnel for the Mental Health Review Board, is under consideration with the Department and the appointments of the personnel would likely be done within a period of next 3 (three) weeks.
“Keeping in view the assurance given by the learned Senior Government Advocate, we deem it appropriate to list this matter on July 10, 2024. If the personnel are not appointed in the Mental Health Review Board by the next date of hearing, the Principal Secretary, Health and Family Welfare, Nagaland, who is the Chairperson of the State Mental Health Authority, Nagaland, shall remain present before this Court on the next date fixed”, the order read.
The case pertains to a Public Interest Litigation (PIL) filed by a resident of Kohima Town in 2021.
