Health Department hit with lawsuit over promotion bungle

DIMAPUR, JANUARY 27: Another group of Female Health Workers (FHW) employed in the State’s Health and Family Welfare Department has launched a lawsuit against the authorities after the authorities had rescinded their promotion.
Court records show that during the height of COVID-19 pandemic, the State Health authorities decided to promote 16 of its FHWs ~ only to withhold the promotion order one month later.
“The petitioners were initially appointed as Female Health Workers and Auxiliary Nurse-Midwife (FHW/ANM). They were subsequently promoted and currently working as FHW Grade-1. By the order dated June 9, 2020, issued by the Government of Nagaland, Directorate of Health & Family Welfare, Nagaland, Kohima, the petitioners were promoted to the post of Female Health Worker Supervisors. The order dated June 9, 2020, was issued consequent to the approval of the P&AR Department and concurrent to the Finance Department.
“However, by the letter dated July 8, 2020, issued by the Government of Nagaland, Health & Family Welfare Department, under the signature of the Secretary of the said Department, the Principal Director, Health & Family Welfare Department, Nagaland, Kohima, was asked to put on hold the office order dated June 9, 2020, by which the petitioners were promoted from FHW Grade-1 to FHW Supervisors”, it stated.
Reason cited for withholding the promotion order was that the proposal to upgrade the FHW Supervisors to FHW Special Grade was yet to be taken up by the State Cabinet.
“It is however the case of the petitioners that by the order dated March 27, 2023, the Senior FHW Supervisors are already upgraded to FHW, and therefore, there is no reason as to why the Government should not implement the order dated June 9, 2020, promoting the petitioners from FHW Grade-I to FHW Supervisor.
“In the present petition, the petitioners have prayed for quashing and setting aside the letter dated July 8, 2020, issued by the Health & Family Welfare Department, Nagaland, Kohima, withholding the order dated June 9, 2020, and to promote the petitioners from FHW Grade-1 to FHW Supervisor) in terms of the order dated June 9, 2020, issued by the Directorate of health & Family Welfare”, it stated.
When the matter was last heard on January 24, N Angami, Senior Government Advocate, informed the Court that in terms of the letter dated August 22, 2023, the Department was making every endeavour to give retrospective promotion to the petitioners. However, since some formalities have to be complied with, he sought for three weeks’ time.
“Three weeks’ time is accordingly granted to the learned Senior Government Advocate to place the necessary instructions on the steps taken by the Government to retrospectively give promotion to the petitioners.
“In the event of failure to place the instructions on the next date fixed, the matter shall be disposed on merit. List it after three (3) weeks”, stated an order issued by Justice Kakheto Sema.
