HC orders DoF&CS consider man’s appointment on compassionate ground

DIMAPUR, SEPTEMBER 25: The Kohima Bench of Gauhati High Court has ordered the State’s Food and Civil Supplies (FCS) Department to consider the case for appointment of a man on compassionate ground and pass a reasoned order within 4 months.
The petitioner, Imti Imchen, submitted that his father had died in harness, due to COVID-19, on May 10 last year while serving as Sub-Inspector in the office of the Director of FCS, Dimapur.
According to Court records, the father of the petitioner was regularised as Store Keeper by an order issued by the Director of FCS on May 18, 1995.
After the death of his father, the petitioner made an application on August 9, 2021 before the Director of FCS praying for appointment on compassionate ground.
“It is the case of the petitioner that till date, no steps have been taken by the respondents to consider the case of the petitioner for appointment on compassionate ground. The Personnel and Administrative Reforms Department (Administrative Reforms Branch), Government of Nagaland, issued an Office Memorandum dated September 17, 2015 providing the revised compassionate appointment scheme for the State Government who dies in harness.
“Considering the nature of the case, this Court does not find it necessary to keep this writ petition pending”, read the order issued on September 23.
Accordingly, Justice LS Jamir disposed of the petition at the motion stage with a directive to the State respondents to “consider the case of the petitioner for appointment on compassionate ground strictly in terms of the Office Memorandum dated September 17, 2015 and also considering his seniority position and thereafter, passed a reasoned order and in accordance with law within a period of 4 (four) months from the date of receipt of a certified copy of this order”.
