HC keeps in abeyance DoH&TE’s transfer order of Asst. Prof

DIMAPUR, DECEMBER 2: The Kohima Bench of Gauhati High Court has kept in abeyance a transfer order issued by the State Department of Higher & Technical Education ordering the transfer of an Assistant Professor from Dimapur Government College to Sao Chang College, Tuensang, within one month of being transferred to Dimapur Government College from Wangkhao Government College, Mon.
The petitioner, who is an Assistant Processor in English, has filed a writ petition in the Kohima Bench of Gauhati High Court challenging the order transferring her to Sao Chang College, Tuensang, without giving any reason or justification for modification/changing of the earlier transfer order transferring her to Dimapur Government College from Wangkhao Government College, Mon.
According to Court document, the petitioner posted at Wangkhao Government College, Mon, was transferred to Dimapur Government College by general transfer order dated October 10, 2022 issued by the Department of Higher & Technical Education. However, on November 9, 2022, by another order issued by the same Department, she was transferred to Sao Chang College, Tuensang, without giving any reason or justification for modification/changing of the earlier transfer order.
Counsel appearing for the petitioner, Advocate Wati Jamir submitted that when a transfer order has been issued, if the same authority issues another order modifying or changing the same, reason should be given otherwise the order becomes illegal.
After hearing submissions from the petitioner’s Counsel and the Government Advocate, Justice Songkhupchung Serto issued notice to the respondents making the same returnable within 4 weeks. Till the returnable date, the impugned order dated November 9, 2022 shall remain in abeyance in respect of the petitioner and the private respondent No.4, the order said.
