Contractor seeks release of fund for 2013-14 Veterinary project

DIMAPUR, JULY 31: The Kohima Bench of Gauhati High Court has issued a notice to Nagaland Government in connection with its alleged failure to release fund to a local contractor engaged in construction of a Government facility at Noksen in Tuensang district since 2014.

According to Court document, the Executive Engineer of PWD (H), Div-V, Veterinary & Animal Husbandry, Government of Nagaland, vide letter dated 26/11/2014, had issued a work order for construction of Veterinary Health Centre at Noksen ~ under State Plan 2013-14 i/c site levelling for a contract amount of Rs 14,78,000 ~ to M/S MC Ongbou Chang.
The Contractor had completed the site levelling works for which an amount of Rs 1,50,000 was released to him in 2014.
“But thereafter, no more fund was released by the Government in spite of the request made by the Director of the Department. Therefore, the petitioner is unable to complete the project though he has placed all his machineries required for continuation and completion of the entire work. Being aggrieved for non-release of the fund for completion of the project, the petitioner is here before this Court praying for issuance of appropriate direction, directing the respondents to release the same so that he may be able to complete the project”, it stated.
The petitioner, MC Ongbou Chang, had filed the case against Nagaland Government represented by Chief Secretary, Finance Commissioner, Commissioner and Secretary Animal Husbandry and Veterinary Services Department, Director of Animal Husbandry and Veterinary Services Department, and Executive Engineer of PWD (H) Div-V Animal Husbandry and Veterinary Services Department.

In an order issued on July 29, Justice Songkhupchung Serto served the notice to the State respondents, which is returnable within 4 weeks. He also listed the matter to be heard again after four weeks.
Advocate Moa Jamir represented the petitioner while the State respondents were represented by Senior Government Advocate Moa Imchen, who accepted the notice on behalf of all the respondents.
