
DIMAPUR, OCTOBER 3: The Kohima Bench of Gauhati High Court on Tuesday issued notice to Nagaland Government and the Police Department over alleged contempt of Court order.
According to Court records, the contempt petition was filed by Yungla Phom, whose deceased husband was a retired Armed Branch Constable in Nagaland Police.
“This is an application under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India.
“The learned Counsel for the petitioner submits that there is deliberate non-compliance of this Court’s order dated December 12, 2022 passed in WP(C)/334/2021, wherein this Court had directed that the respondents were to process the application of the petitioner and ensure that the petitioner enjoys her family pension by the end of four months from the date of the order”, stated an order issued by Justice Marli Vankung.
However, the Court was informed that the petitioner was yet to receive her pension in terms of its December 12, 2022 order and hence the contempt petition.
“Issue notice to the respondents through Registered Post with A/D within a period of 3 days returnable by 3 weeks. List this matter after 3 weeks”, the order stated.
The State respondents named in the petition are Chief Secretary J Alam, Principal Secretary Abhijit Sinha, Principal Accountant General (A and E) A Pitoho Chophy and Director General of Police Rupin Sharma.
