HC issues notice on widow’s petition

DIMAPUR, FEBRUARY 19: The Kohima Bench of Gauhati High Court on Monday issued notice to its Principal Bench (Gauhati High Court) and the State’s Law and Justice Department in connection with a widow’s petition concerning her late husband’s employment record.
“Issue notice making it returnable on March 11, 2024”, stated an order issued by Justice Devashis Baruah after hearing a petition filed by Neiu Chadi.
According to the petitioner, her husband late Dietholie Chadi was working as a UDA-cum-Peshkar in the Court of the Principal District & Sessions Judge, Dimapur, when he passed away on May 9, 2022.
“It is the specific case of the petitioner that the service conditions of the petitioner’s husband was regulated by the Nagaland District Court Employees Service Rules, 2017 and as such, in terms with Rule 24 of the said Rules the retirement age of the petitioner’s husband would be 60 (sixty) years.
“However, by the impugned Letter dated July 18, 2023, the Office of the respondent No. 6 (Accountant General of Nagaland) has initiated steps for recovering on the ground of incorrect fixation of the pay as well as on the ground of overstay”, stated the order.
The Judge directed the respondents to file their affidavit on or before the next date bringing on record their stand and stating inter alia as to whether the service of the husband of the petitioner would be regulated as per the Nagaland District Court Employees Service Rules 2017 or any other Rules.
