HC gives Finance Commissioner last chance in Wokha District Dobashis’ salary case

DIMAPUR, JUNE 9: The Kohima Bench of Gauhati High Court has given one last chance to the Finance Commissioner of Nagaland to file a counter affidavit in a case concerning the salary of Dobashis in Wokha District.
“The instant writ petition has been filed by the petitioners claiming that the petitioners are entitled to their salary in terms with the ROP Rules, 2017 as well as other consequential benefits.
“It is seen that the Respondent Nos. 1 to 4 (Chief Secretary, Home Commissioner, Commissioner to the Government of Nagaland, and Deputy Commissioner of Wokha) had filed an affidavit-in-opposition stating inter alia that the instant writ petition is not maintainable inasmuch as the Finance Commissioner to the Government of Nagaland, Finance Department was not made a party to the instant proceedings”, stated an order issued by Justice Devashis Baruah on June 7.
The petition was filed by 38 Dobashis of Wokha DIstrict.
“Be that as it may, the Finance Commissioner, Government of Nagaland, has been duly made a party in the instant proceedings and has been arrayed as Respondent No. 5. It is also taken note of that on the earlier occasions i.e. on November 6, 2023; February 8, 2024; March 4, 2024; April 9, 2024 and May 9, 2024, the Respondents have taken time for filing their affidavit-in-opposition on behalf of the Respondent No.5.
“However, till date, no affidavit-in-opposition has been filed by the Respondent No. 5. Under such circumstances, at the request of Ms. Inaholi Wotsa, the learned Government Advocate, appearing on behalf of the State of Nagaland, this Court for the ends of justice grants a final opportunity to the Respondent No.5 to file their affidavit-in-opposition”, stated the order.
It directed the Finance Commissioner to file the affidavit on or before July 2.
“It is made clear that if the Respondent No. 5 fails to do so, the instant writ petition shall be taken up for disposal on the basis of the materials available on record. List the matter again on July 5, 2024”, the order stated.
