HC bars officials from filling Yoruba VC Chairman seat

DIMAPUR, AUGUST 27: The Kohima Bench of Gauhati High Court has issued an interim order barring the State’s Home Department and Phek district administration from filling up the post of the Chairman of Yoruba Village Council (YVC).
The case pertains to a petition filed by Vethisa Lohe, the former Chairman of YVC.
“The petitioner is aggrieved by the report on special session in regard to Yoruba Village dated July 27, 2023, by which the EAC (Sadar) office of the Deputy Commissioner, Phek, Nagaland, recommended the removal of the petitioner as Chairman of the said council and consequent to which the order dated July 25, 2023, was passed by the Deputy Commissioner, Phek, Nagaland, removing the petitioner from the post of the Village Council Chairman of Yoruba.
“It is submitted by Mr. Joshua Sheqi, learned Counsel for the petitioner, that the order dated July 25, 2023 is a violation of Section 9 of the Nagaland Village Council Act, 1978”, stated an order issued by Justice Kakheto Sema on August 25.
The Judge directed the Registry to issue notice to the respondents, returnable within four weeks.
“List the matter after four weeks. In the interim, it is ordered that the State respondents more particularly respondent Nos. 2, 3, 4 and 5 (Home Commissioner, Commissioner, Phek DC, and Chozuba ADC) shall not fill up the post of the Chairman of Village Council Yoruba Village either by way of selection/election till the next returnable date”, the order stated.
