DIMAPUR, JUNE 8: The Kohima Bench of Gauhati issued an interim order on Thursday barring Nagaland Industrial Development Corporation (NIDC) from acting on the seniority list of General Managers notified April 21, 2023, for further promotion in the Department, without the Court’s permission.
Court records show that the Writ Petition was filed by Joyee Sen, challenging the office circular containing the seniority list of General Managers in NIDC.
“…the instant Writ Petition has been filed inter alia contending that the respondent No. 3 (Temjenyanger Jamir), who is junior to the petitioner in service, has been shown above her in the seniority list.
“In support of his argument, Mr. A Zhimomi (petitioner’s Counsel), has taken the Court through the documents annexed to the Writ Petition. After going through the same, this Court is of the opinion that this matter would require deeper examination. Issue notice of motion returnable in 4 weeks”, stated an order issued by Justice Suman Shyam.
On the request for interim order, the Judge stated: “Having regard to the facts and circumstances of this case, as an ad interim measure, it is hereby provided that the respondents shall not act on the basis of the office Circular dated April 21, 2023, for further promotion in the Department, without the leave of this Court”.
