HC allows time to file counter-affidavit to IAS Officer’s petition

DIMAPUR, JUNE 27: The Counsel representing two private respondents named in the petition filed by IAS officer Reny Wilfred seeking the transfer of a criminal case registered against him has appealed for more time to file a counter-affidavit.
On Monday, the Kohima Bench of Gauhati High Court conducted the second hearing of the case since the petition was filed on June 15.
In his order, Justice Kakheto Sema stated: “List the matter after two weeks for enabling the learned Counsel for the respondent Nos. 2 and 3 to file counter-affidavit. The interim order passed earlier shall continue till the next returnable date”.
Wilfred, who is currently working as Joint Secretary of Planning and Coordination Department, is facing charges of sexual misconduct during his stint as Deputy Commissioner of Noklak.
He has been accused of sexual misconduct against two minor girls at Noklak ~ a formal complaint was filed on July 27, 2021 at Noklak Police Station.
On June 16, he had approached the Kohima Bench of Gauhati High Court seeking the transfer of his trial from the POCSO Court at Tuensang “to the nearest Court” citing apprehension that he will never get a free and fair trial in the Tuensang Court.
That day, his Counsel submitted that Wilfred has been facing serious threat to his life and personal liberty. He also submitted that his client will never get a free and fair trial in the POCSO Court at Tuensang due to a social media campaign against him.
Then the Court had stayed further proceedings of the case pending before POCSO Court, Tuensang, till the returnable date.
