DIMAPUR, JULY 22: The Kohima Bench of Gauhati High Court on Thursday rejected the bail application of BD Jangade, General Manager, National Highways and Infrastructure Development Corporation Limited (NHIDCL), who was arrested on June 2 last, under the Prevention of Corruption Act, 2015 and is in judicial custody.
Following a complaint lodged by Deputy Commissioner, Mokokchung, to the Superintendent of Police, Mokokchung, after a video went viral showing BD Jangade demanding a cut of 1% from every contract work executed by contractors as his share, an FIR under Section 406 of IPC read with Section 7 of the Prevention of Corruption Act was registered at Mokokchung PS and the accused was arrested on June 2, 2021 and remanded to police custody for 15 days.
During that time, the State Crime PS took over the case and the FIR was re-registered as State crime PS case 03/21, under Section 406 and 409 IPC read with Sections 7 and 8 of the Prevention of Corruption Act, 2015.
In an order after hearing the bail application today, Justice Songkhupchung Serto said the offences charged against the accused are serious in nature and there is a strong prima facie case against the accused.
“Further, it appears from the case diary that the investigation is going on full swing and it is at a crucial stage. Therefore, release of the accused on bail, at this stage is likely to jeopardize the smooth progress of the investigation”, the order said while rejecting his bail application.
