Clarification on 2 prohibitory orders in Dimapur

Dimapur, April 6: In the wake of confusion over two prohibitory orders issued from the offices of Deputy Commissioner Dimapur and Commissioner Police Dimapur, the district publicity officer has clarified that in Dimapur two prohibitory orders are being issued because of the functioning of Commissionerate system, wherein the powers to promulgate prohibition under Section 144 CrPC (restriction of public movement and vehicular movement which are not permitted under essential category) rest with CP.
Under the Disaster Act orders pertaining to opening/ closure of all shops dealing with essential commodities is with DC being health disaster issue in the present situation and not law and order situation.
Had it been a law and order issue, only the CP would be empowered for imposition of the prohibitory orders, it said.
“In other districts, only one order is issued by the Deputy Commissioner as in the absence of Commissionerate, the legislative power of Section 144 CrPC also rests with the DC and perhaps this may be the reason for confusion amongst the public.”
“DPRO Dimapur has confirmed from both the DC and CP Dimapur on this issue so that public may not view it as authority class/ mis-communication between the two offices and also not be confused as orders are issued according to law,” it added. (Page News Service)
