Repeals Act, passes resolution on POCSO, introduces 3 Bills

KOHIMA, SEPTEMBER 11: The 4-day second session of the 14th Nagaland Legislative Assembly (NLA) commenced here today.
On the first day, the NLA repealed the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition), Act, 1993 with the enactment of the new Act – The Prohibition of Employment as Manual Scavengers and their Rehabilitation Act 2013.
Chief Minister Neiphiu Rio moving the resolution said “Whereas, in the interest of the public, the State Government had adopted “The Employment of Manual Scavengers & Construction of Dry Latrines (Prohibition), Act, 1993” in the year 2008. Whereas, the Act has become redundant with the enactment of the new Act i.e. The Prohibition of Employment as Manual Scavengers and their Rehabilitation Act 2013.
“And whereas, since The Employment of Manual Scavengers & Construction of Dry Latrines (Prohibition), Act, 1993 was enacted by the Parliament under Article 252 of the Constitution and subsequently, adopted by various States, its repeal can be done only as per the procedure prescribed under Article 252 which require passing of resolution for the repeal of the 1993 Act by the State Legislature.
“And whereas, the Cabinet has approved for repeal of the Act of 1993.”
The House unanimously resolved to repeal Act of 1993 so that the State Government may further take action for adoption of the new Act i.e. The Prohibition of Employment as Manual Scavengers and their Rehabilitation Act 2013.
The resolution was repealed by voice vote.
The House also, in the interest of the public, adopted a Government resolution on The Protection of Children from Sexual Offences (POCSO), Amendment Act, 2019, and The Protection of Children from Sexual Offences (POCSO), Rules, 2020.
Rio said the State Government had adopted The POCSO Act, 2012 on September 26, 2016.
However, the Ministry of Law and Justice notified The POCSO (Amendment) Act, 2019 amending the POCSO Act 2012 on the August 5, 2019 under Article 252 of the Constitution and subsequently, adopted by various States, he said.
Also, in exercise of the powers conferred by Section 45 of POCSO Act, 2012 (32 of 2012)- Powers to make rules, Ministry of Women and Child Development has developed and notified The POCSO, Rules, 2020 on 9th March, 2020, he said.
Informing that the State Cabinet has approved for adoption of The POCSO (Amendment) Act, 2019, and The POCSO, Rules, 2020, he said there is a need to adopt both the Act and Rule.
Subsequently, the resolution was passed by voice vote.
During the day, 3 Government Bills were also introduced:
* Minister for Health & Family Welfare P Paiwang Konyak introduced The Nagaland Motor Vehicles Taxation (Amendment) Bill, 2023 and The Nagaland Passengers & Goods Taxation (Amendment) Bill, 2023.
* Minister for Higher Education Temjen Imna Along introduced North East Christian University (Second Amendment) Bill, 2023.
Assembly Speaker Sharingain Longkumer informed that consideration and passing of the 3 Bills will be taken up tomorrow.
NLA Secretary-in-Charge Khruohituonuo Rio reported the assent of the Governor of Nagaland, La Genesan to The Nagaland Municipal Act 2001 (Repeal Bill, 2023), The Nagaland Fire And Emergency Services Bill-2021, The Nagaland Goods And Services Tax (Sixth Amendment) Bill, 2022; The Nagaland Appropriation Bill (No.1), 2023 and The Nagaland Appropriation Bill (No.2), 2023 which were passed during the March session of the House.
Chief Minister Rio and Speaker Longkumer also made obituary references to the passing away of Late Noke Wangnao, a former Minister and sitting Member of the Assembly who expired on August 28.
The members observed a minute silence in honour of the departed soul and also conveyed condolences to the bereaved family.
Wangnao had served the State in different capacities after being elected for 10 times. He was the longest serving MLA of the State.
Minister for Parliamentary Affairs KG Kenye laid the Fifth Report of the Rules Committee while Advisor & Chairman of the Committee on Public Undertakings tabled the Internal Working Rules of the Committee on Public Undertakings (First Amendment) 2023.
Imchen as Chairman of COPU, presented a copy each of the following reports:
* 123d Report on Action Taken by the Government on the Observations and Recommendations contained in the 111 Report of COPU on the Examination of the Report of the Comptroller & Auditor General of India for the Year 2016-17 pertaining to the Nagaland Hotels Limited (NHL) under the Department of Industries & Commerce.
* 124th Report on Action Taken by the on the Observations and Recommendations contained in the 117 Report of the COPU on the Examination of the Report of the Comptroller & Auditor General of India for the Year 2017-18 pertaining to the Nagaland Hotels Limited (NHL) under the Department of Industries & Commerce.
* 125th Report on Action taken by the Government on the Observations and Recommendations contained in the 94th Report of the COPU on the Examination of the Report of the Comptroller & Auditor General of India for the year 2013-2014 pertaining to the Nagaland Industrial Development Corporation (NIDC) under the Department of Industries & Commerce.
*126th Report on Action taken by the Government on the Observations and Recommendations contained in the 95 Report of the COPU on the Examination of the Report of the Comptroller & Auditor General of India for the year 2014-2015 pertaining to the Nagaland Industrial Development Corporation (NIDC) under the Department of Industries & Commerce.
* 127th Report on Action taken by the Government on the Observations and Recommendations contained in the 99th Report of COPU on the Examination of the Report of the Comptroller & Auditor General of India for the year 2015-2016 pertaining to the Nagaland Industrial Development Corporation (NIDC) under the Department of Industries & Commerce.
* 128th Report on Action taken by the Government on the Observations and Recommendations contained in the 110th Report of the COPU on the Examination of the Report of the Comptroller & Auditor General of India for the year 2016-2017 pertaining to the Nagaland Industrial Development Corporation (NIDC) under the Department of Industries & Commerce.
Advisor and Chairman of the Committee on Estimates (CoE) K Tokugha Sukhalu presented the following reports:
* 148th Report on Action Taken on the Observations Recommendations contained in the 144 Report of the CoE pertaining to the Tourism Department (Hornbill Festival).
